Part 2

Criminal code statutes and traffic statutes are not the most entertaining chapters to read, however they provide a foundation of action for any and all law enforcement officers. If an officer is going to take any legal action towards an individual the action will be based towards the violation of the statute. This means that in order to affect any change in the community it is likely that law enforcement officers will be required to take legal action with a violation of a statute in mind…meaning the law enforcement officer needs to understand the basic meaning of the statute – primarily the elements of the statute to be sure that the individual failed to obey that statute. Taking this one step further, it is important for law enforcement officers to have a firm understanding of statutes that they will be likely enforcing, and for you that means that the Peace Officer Licensing Exam can test your knowledge on any of them.

One method that many find helpful is to draft more complex statutes in outline form, and then they are able to revert back to them as study guides for test preparation. The trick is to provide enough information on your outline to understand the statute, yet not so much that you are copying the statute itself. An example of this method for Burglary (M.S. 609.582s1) would look like this:

  1. 1st Degree Burglary – Felony
    1. Enters Building
      1. Without Consent
      2. Intent
    2. Commits Crime in Building
    3. Person Present (Not Accomplice)
    4. Possesses Dangerous Weapon (or lookalike) or Assaults Other Person

Please use an outline format to recap all the Assault statutes (Ms 609.22, 609.222, 609.223, 609.2231, 609.2233, 609.224, 609.2242) For the listed statutes, provide elements that would be important to study. These elements that you will pull out of the statutes will include key pieces of information such as: level of crime, weapons, what level of injury, aimed towards a specific group of people, and whatever elements are required to charge out the statute. Using an outline format, detail this information, you should be able to use this submission as a study guide for the Peace Officer Licensing Exam as well.
