1. The state of Michigan wants to limit under-age drinking so they enact a statute prohibiting out of state
wineries from selling wine directly to Michigan’s in-state customers—these wineries must go through
distributors. In-state wineries, however, can still sell directly to in-state customers (they don’t have to use
distributors). An out of state winery challenges Michigan’s law on Constitutional grounds. Using the
IRAC method above, be sure to discuss what the Constitutional challenge is and arguments for both sides.
2. Jack, a resident of Louisiana, buys an RV from Ted, a resident of Texas using e-Bay. In the e-Bay ad, Ted
claims the RV is in good condition and that the buyer will enjoy the RV for many years to come. Jack
purchases the RV and it breaks down on the drive back from Texas to Louisiana. Jack sues Ted for
$80,000 in damages. Ted has sold various items on e-Bay in the past. In which courts can Ted be sued and

3. ABC Corp. puts up a large sign, covering 50% of its window, on the building it owns in San Diego. Within
days, city representatives stop by and tell ABC to remove the sign or the company will be fined under San
Diego’s Sign Ordinanace Act. The Sign Act specifies that only 25% of any window can be used for signs.
ABC refuses to move the sign, the city issues a fine, and ABC sues the city, saying the city violated the
company’s first amendment rights. Using IRAC, who wins and why?
4. Beth attends a state high school. She wants to join the boys wrestling team, since there is no female
wrestling team. Her high school won’t allow it, citing the possibility of sexual harassment. Beth sues the
high school stating the school’s policy prohibiting her from joining the boys wrestling team is
unconstitutional. What will the court decide and why? Please provide the issue, rule, analysis and
